Mechanism 2: Safety components in regulated products. If an AI system is used as a safety component in a product governed by EU product safety law (medical devices, automotive, aviation, etc.), it's high-risk regardless of the sector above.
The "significant impact" filter: For Annex III sectors, the full high-risk designation applies when the AI system's output is used to make decisions that significantly affect people's lives. Annex III uses are not uniformly high-risk — a generative AI writing job descriptions isn't the same as an AI screening job applicants. The determining factor is whether the AI output directly drives a consequential individual decision.
Tier 3: Limited-Risk AI
Limited-risk AI systems are those that interact directly with humans in ways that could create confusion about whether they're talking to a person. The primary obligation is transparency: the system must identify itself as AI.
